حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ، حَدَّثَنَا يَحْيَى بْنُ آدَمَ، حَدَّثَنَا ابْنُ إِدْرِيسَ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، عَنْ مَعْمَرِ بْنِ عَبْدِ اللَّهِ بْنِ حَنْظَلَةَ، عَنْ يُوسُفَ بْنِ عَبْدِ اللَّهِ بْنِ سَلاَمٍ، عَنْ خُوَيْلَةَ بِنْتِ مَالِكِ بْنِ ثَعْلَبَةَ، قَالَتْ ظَاهَرَ مِنِّي زَوْجِي أَوْسُ بْنُ الصَّامِتِ فَجِئْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم أَشْكُو إِلَيْهِ وَرَسُولُ اللَّهِ صلى الله عليه وسلم يُجَادِلُنِي فِيهِ وَيَقُولُ ‏"‏ اتَّقِي اللَّهَ فَإِنَّهُ ابْنُ عَمِّكِ ‏"‏ ‏.‏ فَمَا بَرِحْتُ حَتَّى نَزَلَ الْقُرْآنُ ‏‏{‏ قَدْ سَمِعَ اللَّهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا ‏}‏ إِلَى الْفَرْضِ فَقَالَ ‏"‏ يُعْتِقُ رَقَبَةً ‏"‏ ‏.‏ قَالَتْ لاَ يَجِدُ قَالَ ‏"‏ فَيَصُومُ شَهْرَيْنِ مُتَتَابِعَيْنِ ‏"‏ ‏.‏ قَالَتْ يَا رَسُولَ اللَّهِ إِنَّهُ شَيْخٌ كَبِيرٌ مَا بِهِ مِنْ صِيَامٍ ‏.‏ قَالَ ‏"‏ فَلْيُطْعِمْ سِتِّينَ مِسْكِينًا ‏"‏ ‏.‏ قَالَتْ مَا عِنْدَهُ مِنْ شَىْءٍ يَتَصَدَّقُ بِهِ قَالَتْ فَأُتِيَ سَاعَتَئِذٍ بِعَرَقٍ مِنْ تَمْرٍ قُلْتُ يَا رَسُولَ اللَّهِ فَإِنِّي أُعِينُهُ بِعَرَقٍ آخَرَ ‏.‏ قَالَ ‏"‏ قَدْ أَحْسَنْتِاذْهَبِي فَأَطْعِمِي بِهَا عَنْهُ سِتِّينَ مِسْكِينًا وَارْجِعِي إِلَى ابْنِ عَمِّكِ ‏"‏ ‏.‏ قَالَ وَالْعَرَقُ سِتُّونَ صَاعًاقَالَ أَبُو دَاوُدَ فِي هَذَا إِنَّهَا كَفَّرَتْ عَنْهُ مِنْ غَيْرِ أَنْ تَسْتَأْمِرَهُ ‏.‏ وَقَالَ أَبُو دَاوُدَ وَهَذَا أَخُو عُبَادَةَ بْنِ الصَّامِتِ ‏.‏

Narrated Khuwaylah, daughter of Malik ibn Tha'labah

My husband, Aws ibn al-Samit, made me unlawful to him by zihar, so I came to the Messenger of Allah (ﷺ) to complain to him, while the Messenger of Allah (ﷺ) was arguing with me concerning him and saying, "Fear Allah, for he is your cousin." I did not depart until the Quran was revealed:

"Indeed, Allah has heard the statement of the one who argues with you concerning her husband..."

up to the prescription. He said, "He must free a slave." She said, "He does not find one." He said, "Then he must fast for two consecutive months." She said, "O Messenger of Allah, he is an old man, he has no ability to fast." He said, "Then he must feed sixty needy persons." She said, "He has nothing to give in charity." She said: Then at that time a basket (araq) of dates was brought to me. I said, "O Messenger of Allah, indeed I will help him with another basket." He said, "You have done well, so go and feed sixty needy persons on his behalf, and return to your cousin." He said: The basket contains sixty sa's. Abu Dawud said in this: She made expiation for him without his permission. And Abu Dawud said: This is the brother of Ubadah ibn al-Samit.
