حَدَّثَنَا أَبُو كَامِلٍ، حَدَّثَنَا يَزِيدُ يَعْنِي ابْنَ زُرَيْعٍ، ح وَحَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا حَمَّادٌ، - الْمَعْنَى - حَدَّثَنِي مُحَمَّدُ بْنُ عَمْرٍو، حَدَّثَنَا أَبُو سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏تُسْتَأْمَرُ الْيَتِيمَةُ فِي نَفْسِهَا فَإِنْ سَكَتَتْ فَهُوَ إِذْنُهَا وَإِنْ أَبَتْ فَلاَ جَوَازَ عَلَيْهَا ‏"‏ ‏.‏ وَالإِخْبَارُ فِي حَدِيثِ يَزِيدَ ‏.‏ قَالَ أَبُو دَاوُدَ وَكَذَلِكَ رَوَاهُ أَبُو خَالِدٍ سُلَيْمَانُ بْنُ حَيَّانَ وَمُعَاذٌ عَنْ مُحَمَّدِ بْنِ عَمْرٍو ‏.‏

Narrated Abu Hurairah

The Messenger of Allah (ﷺ) said: "The orphan girl must be consulted regarding herself; if she remains silent, then that is her permission, and if she refuses, then there is no authority over her." And the wording "informing" is in the tradition of Yazid.

Abu Dawud said: This tradition has likewise been transmitted by Abu Khalid Sulaiman bin Hayyan and Mu'adh from Muhammad bin 'Amr.
