Sunan Abi Dawud 4494
حَدَّثَنَا مُحَمَّدُ بْنُ الْعَلاَءِ، حَدَّثَنَا عُبَيْدُ اللَّهِ، - يَعْنِي ابْنَ مُوسَى - عَنْ عَلِيِّ بْنِ صَالِحٍ، عَنْ سِمَاكِ بْنِ حَرْبٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ كَانَ قُرَيْظَةُ وَالنَّضِيرُ - وَكَانَ النَّضِيرُ أَشْرَفَ مِنْ قُرَيْظَةَ - فَكَانَ إِذَا قَتَلَ رَجُلٌ مِنْ قُرَيْظَةَ رَجُلاً مِنَ النَّضِيرِ قُتِلَ بِهِ وَإِذَا قَتَلَ رَجُلٌ مِنَ النَّضِيرِ رَجُلاً مِنْ قُرَيْظَةَ فُودِيَ بِمِائَةِ وَسْقٍ مِنْ تَمْرٍ فَلَمَّا بُعِثَ النَّبِيُّ صلى الله عليه وسلم قَتَلَ رَجُلٌ مِنَ النَّضِيرِ رَجُلاً مِنْ قُرَيْظَةَ فَقَالُوا ادْفَعُوهُ إِلَيْنَا نَقْتُلْهُ . فَقَالُوا بَيْنَنَا وَبَيْنَكُمُ النَّبِيُّ صلى الله عليه وسلم فَأَتَوْهُ فَنَزَلَتْ { وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ } وَالْقِسْطُ النَّفْسُ بِالنَّفْسِ ثُمَّ نَزَلَتْ { أَفَحُكْمَ الْجَاهِلِيَّةِ يَبْغُونَ } . قَالَ أَبُو دَاوُدَ قُرَيْظَةُ وَالنَّضِيرُ جَمِيعًا مِنْ وَلَدِ هَارُونَ النَّبِيِّ عَلَيْهِ السَّلاَمُ .
Muhammad ibn al-Ala narrated to us: Ubaydullah, meaning Ibn Musa, narrated to us, from Ali ibn Salih, from Simak ibn Harb, from Ikrimah, from Ibn Abbas, who said: Qurayzah and al-Nadir—al-Nadir being more noble than Qurayzah—had this practice: if a man from Qurayzah killed a man from al-Nadir, he was killed in retribution; but if a man from al-Nadir killed a man from Qurayzah, he was ransomed for one hundred wasqs of dates. When the Prophet ﷺ was sent, a man from al-Nadir killed a man from Qurayzah. They said: Hand him over to us so that we may kill him. The others said: Let the Prophet ﷺ judge between us. They went to him, and this verse was revealed: If you judge, judge between them with justice. Justice means a life for a life. Then this verse was revealed: Do they seek the judgment of the pre-Islamic era? Abu Dawud said: Qurayzah and al-Nadir are both descendants of the Prophet Aaron, peace be upon him.
