Sunan Abi Dawud 4499
حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ عُمَرَ بْنِ مَيْسَرَةَ الْجُشَمِيُّ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ عَوْفٍ، حَدَّثَنَا حَمْزَةُ أَبُو عُمَرَ الْعَائِذِيُّ، حَدَّثَنِي عَلْقَمَةُ بْنُ وَائِلٍ، حَدَّثَنِي وَائِلُ بْنُ حُجْرٍ، قَالَ كُنْتُ عِنْدَ النَّبِيِّ صلى الله عليه وسلم إِذْ جِيءَ بِرَجُلٍ قَاتِلٍ فِي عُنُقِهِ النِّسْعَةُ قَالَ فَدَعَا وَلِيَّ الْمَقْتُولِ فَقَالَ " أَتَعْفُو " . قَالَ لاَ . قَالَ " أَفَتَأْخُذُ الدِّيَةَ " . قَالَ لاَ . قَالَ " أَفَتَقْتُلُ " . قَالَ نَعَمْ . قَالَ " اذْهَبْ بِهِ " . فَلَمَّا وَلَّى قَالَ " أَتَعْفُو " . قَالَ لاَ . قَالَ " أَفَتَأْخُذُ الدِّيَةَ " . قَالَ لاَ . قَالَ " أَفَتَقْتُلُ " . قَالَ نَعَمْ . قَالَ " اذْهَبْ بِهِ " . فَلَمَّا كَانَ فِي الرَّابِعَةِ قَالَ " أَمَا إِنَّكَ إِنْ عَفَوْتَ عَنْهُ يَبُوءُ بِإِثْمِهِ وَإِثْمِ صَاحِبِهِ " . قَالَ فَعَفَا عَنْهُ . قَالَ فَأَنَا رَأَيْتُهُ يَجُرُّ النِّسْعَةَ .
Ubaydullah ibn Umar ibn Maysarah al-Jushami narrated to us: Yahya ibn Said narrated to us, from Awf: Hamzah Abu Umar al-Aidhi narrated to us: Alqamah ibn Wail told me: Wail ibn Hujr told me: I was with the Prophet ﷺ when a killer was brought with a leather strap around his neck. He called the victim’s heir and asked: Will you pardon him? The heir said no. He asked: Will you take blood money? He said no. He asked: Will you kill him? He said yes. The Prophet ﷺ told him to take the man away. When he turned to leave, he asked again whether he would pardon him; the heir said no. He asked whether he would take blood money; he said no. He asked whether he would kill him; he said yes. The Prophet ﷺ told him to take the man away. When this happened for the fourth time, he said: If you pardon him, he will bear his own sin and that of his victim. The heir pardoned him. Wail said: I saw him afterward dragging the leather strap.
