حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، حَدَّثَنَا لَيْثٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ، عَنْ أَبِي هُرَيْرَةَ، وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، رضى الله عنهم أَنَّهُمَا قَالاَ إِنَّ رَجُلاً مِنَ الأَعْرَابِ أَتَى رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ رَسُولَ اللَّهِ أَنْشُدُكَ اللَّهَ إِلاَّ قَضَيْتَ لِي بِكِتَابِ اللَّهِ. فَقَالَ الْخَصْمُ الآخَرُ وَهْوَ أَفْقَهُ مِنْهُ نَعَمْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ، وَائْذَنْ لِي. فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " قُلْ ". قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا، فَزَنَى بِامْرَأَتِهِ، وَإِنِّي أُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ، فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَوَلِيدَةٍ، فَسَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّمَا عَلَى ابْنِي جَلْدُ مِائَةٍ، وَتَغْرِيبُ عَامٍ، وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ. فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " وَالَّذِي نَفْسِي بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ، الْوَلِيدَةُ وَالْغَنَمُ رَدٌّ، وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ، اغْدُ يَا أُنَيْسُ إِلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا ". قَالَ فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ، فَأَمَرَ بِهَا رَسُولُ اللَّهِ صلى الله عليه وسلم فَرُجِمَتْ.
Qutayba ibn Saʿid narrated to us; Layth narrated to us, from Ibn Shihab, from ʿUbayd Allah ibn ʿAbd Allah ibn ʿUtba ibn Masʿud, from Abu Hurayra and Zayd ibn Khalid al-Juhani (may Allah be pleased with them), who said: A man from the Bedouins came to the Messenger of Allah and said, “I adjure you by Allah to judge for me according to the Book of Allah.” The other disputant, who was more knowledgeable than he, said, “Yes, judge between us according to the Book of Allah, and let me speak.” The Messenger of Allah said, “Speak.”
He said, “My son worked for this man and committed unlawful sexual intercourse with his wife. I was told that stoning was due for my son, so I ransomed him for one hundred sheep and a slave girl. I asked the people of knowledge, and they told me that my son was due one hundred lashes and exile for a year, and that this man’s wife was due stoning.” The Messenger of Allah said, “By Him in whose hand is my soul, I will judge between you according to the Book of Allah: the slave girl and sheep are to be returned; your son is due one hundred lashes and exile for a year. Go tomorrow, Unays, to this man’s wife; if she confesses, stone her.” He went to her the next morning, and she confessed. The Messenger of Allah then ordered that she be stoned.
