Musaddad narrated to us: Abd al-Wahid narrated to us: Ma mar narrated to us, from al-Zuhri, from Abu Salama ibn Abd al-Rahman, from Jabir ibn Abdullah, may Allah be pleased with them both, who said: The Messenger of Allah ruled that the right of pre-emption applies to everything that has not been divided. Once boundaries have been set and routes laid out, there is no right of pre-emption.

Chapter 2

Al-Makki ibn Ibrahim informed us: Ibn Jurayj informed us: Ibrahim ibn Maysara informed me, from Amr ibn al-Sharid, who said: I was standing with Sad ibn Abi Waqqas when al-Miswar ibn Makhrama came and put his hand on one of my shoulders. Then Abu Rafi, the freedman of the Prophet, came and said, “Sad, buy my two houses in your property.” Sad replied, “By Allah, I will not buy them.” Al-Miswar said, “By Allah, you will buy them.” Sad said, “By Allah, I will not offer you more than four thousand, payable in installments.” Abu Rafi said, “I was offered five hundred dinars for them. If I had not heard the Prophet say that a neighbor has greater right to what is adjacent to him, I would not give them to you for four thousand when I am being offered five hundred dinars.” So he paid him for them.

To which of them should I give a gift?” He replied: “To the one whose door is nearer to you.”
