Abū Hurayra reported that the Messenger of God said, “A previously married woman must not be married until she is consulted, and a virgin must not be married until her permission is sought.” They asked, “How does she give permission?” He replied, “By remaining silent.” Some people said: “If a man uses two false witnesses to claim that a previously married woman was married to him with her consent, and the judge confirms the marriage even though the husband knows that he never married her at all, then this marriage is permissible for him, and there is no harm in continuing to live with her.”
