Sahih al-Bukhari 6977

ʿAmr ibn al-Sharīd said: Al-Miswar ibn Makhrama placed his hand on my shoulder and took me with him to Saʿd. Abū Rāfiʿ said to al-Miswar, “Will you not tell this man to buy from me the house I own in my compound?” Al-Miswar replied, “I will not offer him more than four hundred, either in installments or in scheduled payments.” Abū Rāfiʿ said, “I was offered five hundred in cash, but I refused. Were it not that I heard the Prophet say, ‘A neighbor has greater right to his adjacent property,’ I would not have sold it to you”—or he said, “I would not have given it to you.” I said to Sufyān, “Maʿmar did not relate it this way.” He replied, “But he related it to me this way.” Some people said: “If someone wants to sell property subject to pre-emption, he may use a stratagem to nullify the right: the seller gives the house to the buyer, marks its boundaries, and hands it over to him; then the buyer compensates him with one thousand dirhams. In that case, the person with the right of pre-emption has no claim to it.”
