Sahih al-Bukhari 6978
حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا سُفْيَانُ، عَنْ إِبْرَاهِيمَ بْنِ مَيْسَرَةَ، عَنْ عَمْرِو بْنِ الشَّرِيدِ، عَنْ أَبِي رَافِعٍ، أَنَّ سَعْدًا، سَاوَمَهُ بَيْتًا بِأَرْبَعِمِائَةِ مِثْقَالٍ فَقَالَ لَوْلاَ أَنِّي سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ " الْجَارُ أَحَقُّ بِصَقَبِهِ " . لَمَا أَعْطَيْتُكَ. وَقَالَ بَعْضُ النَّاسِ إِنِ اشْتَرَى نَصِيبَ دَارٍ، فَأَرَادَ أَنْ يُبْطِلَ الشُّفْعَةَ، وَهَبَ لاِبْنِهِ الصَّغِيرِ وَلاَ يَكُونُ عَلَيْهِ يَمِينٌ.
Abū Rāfiʿ reported that Saʿd negotiated with him over a house for four hundred *mithqāls*. Abū Rāfiʿ said, “Were it not that I heard the Messenger of God say, ‘A neighbor has greater right to his adjacent property,’ I would not have given it to you.” Some people said: “If someone buys a share in a house and wants to nullify the right of pre-emption, he may give it to his young son, and no oath is required of him.”
