Muwatta Malik

Yahya related to me from Malik from Ibn Shihab from Said ibn al- Musayyab that the Messenger of Allah, may Allah bless him and grant him peace, said, "Anyone who eats this plant should not come near our mosques. The smell of the garlic will offend us."

Yahya related to me that Malik said, "The sunna concerning thetime of prayer on the ids of Fitr and Adha - and there is nodisagreement amongst us about it - is that the imam leaves his houseand as soon as he has reached the place of prayer the prayer fallsdue."

Yahya said that Malik was asked whether a man whoprayed with the imam could leave before the khutba, and he said, "Heshould not leave until the imam leaves."

Yahya related to me from Malik from Yahya ibn Said that Said ibnal-Musayyab said, "The Messenger of Allah, may Allah bless him andgrant him peace, did not pray dhuhr and asr on the day of the Trenchuntil after the sun had set."

Malik said, "The hadith of al-Qasim ibn Muhammad from Salih ibn Khawwat is the one I like most outof what I have heard about the fear prayer."

Yahya related to me from Malik from Hisham ibn Urwa from Fatimabint al Mundhir that Asma bint Abi Bakr as-Siddiq said, "I went toA'isha, the wife of the Prophet, may Allah bless him and grant himpeace, during an eclipse of the sun, and everybody was standing inprayer, and she too was standing praying. I said, 'What is everybodydoing?' She pointed towards the sky with her hand and said, 'Glory beto Allah.' I said, 'A sign?' She nodded 'Yes' with her head."

She continued, "I stood until I had almost fainted, and I began topour water over my head. The Messenger of Allah, may Allah bless himand grant him peace, praised Allah and spoke well of Him, and thensaid, 'There is nothing which I had previously not seen beforehandthat I have not now seen while standing - even the Garden and theFire. It has been revealed to me that you will be tried in your graveswith a trial, like, or near to, the trial of the Dajjal (I do not knowwhich one Asma said). Every one of you will have someone who comes tohim and asks him, 'What do you know about this man?' A mumin, or onewho has certainty (muqin) (I do not know which one Asma said), willsay, 'He is Muhammad, the Messenger of Allah, may Allah bless him andgrant him peace, who came to us with clear proofs and guidance, and weanswered and believed and followed.' He will then be told, 'Sleep in agood state. We know now that you were a mumin.' A hypocrite, however,or one who has doubts (l do not know which one Asma said), will say,'I do not know, I heard everybody saying something and I said it.' "

Yahya related to me from Malik that he had heard that Abu Hurayraused to say, when morning came after it had rained on the people, "Wehave been rained upon by the rain of Allah's opening," and would thenrecite the ayat, "Whatever Allah opens to man of His mercy no-one canwithhold, and whatever He withholds no-one can send forward after Him." (Sura 35 ayat 2).

Yahya related to me from Malik from Yahya ibn Said from Amra bintAbd ar-Rahman that A'isha, the wife of the Prophet, may Allah blesshim and grant him peace, said, "If the Messenger of Allah, may Allahbless him and grant him peace, had seen what women do now, he wouldhave forbidden them to go into the mosques, just as the women of theBani Israil were forbidden."

Yahya ibn Said said that heasked Amra, "Were the women of the Bani Israil forbidden to go intothe mosques?" and she said, "Yes."

Yahya related to me from Malik from Ibn Shihab from as-Sa'ib ibnYazid that he saw Umar ibn al-Khattab beating al-Munkadir for prayingafter asr.

Yahya related to me from Malik from Nafi that Abu Hurayra said,"Make your funerals speedy, for it is only good that you are advancinghim towards, or evil that you are taking off your necks."

Yahya related to me from Malik that he asked Ibn Shihab aboutolives and he said, "There is a tenth on them."Malik said,"The tenth that is taken from olives is taken after they have beenpressed, and the olives must come to a minimum amount of five awsuqand there must be at least five awsuq of olives. If there are lessthan five awsuq of olives, no zakat has to be paid.Olivetrees are like date palms insofar as there is a tenth on whatever iswatered by rain or springs or any natural means, and a twentieth onwhatever is irrigated. However, olives are not estimated while on thetree. The sunna with us as far as grain and seeds which people storeand eat is concerned is that a tenth is taken from whatever has beenwatered by rain or springs or any natural means, and a twentieth fromwhatever has been irrigated, that is, as long as the amount comes tofive awsuq or more using the aforementioned sa, that is, the sa of theProphet, may Allah bless him and grant him peace. Zakat must be paidon anything above five awsuq according to the amount involved."Malik said, "The kinds of grain and seeds on which there is zakatare

Yahya related to me that Malik said, "A man does not have to payzakat for the slaves of his slaves, or for some one employed by him,or for his wife's slaves, except for anyone who serves him and whoseservices are indispensable to him, in which case he must pay zakat. Hedoes not have to pay zakat for any of his slaves that are kafir andhave not become muslim, whether they be for trade or otherwise."

Yahya related to me from Malik that he had heard that the peopleof knowledge did not disapprove of people fasting using tooth-sticksat any hour of the day in Ramadan, whether at the beginning or theend, nor had he heard any of the people of knowledge disapproving ofor forbidding the practice.

Yahya said that he heard Maliksay, about fasting for six days after breaking the fast at the end ofRamadan, that he had never seen any of the people of knowledge andfiqh fasting them. He said, "I have not heard that any of ourpredecessors used to do that, and the people of knowledge disapproveof it and they are afraid that it might become a bida and that commonand ignorant people might join to Ramadan what does not belong to it,if they were to think that the people of knowledge had givenpermission for that to be done and were seen doing it.

Yahyasaid that he heard Malik say, "I have never heard any of the people ofknowledge and fiqh and those whom people take as an example forbiddingfasting on the day of jumua. Fasting on it is good, and I have seenone of the people of knowledge fasting it, and it seemed to me that hewas keen to do so."
