عَنْ أَبِي خَلْدَةَ الزُّرَقِيِّ قَالَ: جِئْنَا أَبَا هُرَيْرَةَ فِي صَاحِبٍ لَنَا قَدْ أَفْلَسَ فَقَالَ: هَذَا الَّذِي قَضَى فِيهِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أَيُّمَا رَجُلٍ مَاتَ أَوْ أَفْلَسَ فَصَاحِبُ الْمَتَاعِ أَحَقُّ بِمَتَاعِهِ إِذَا وَجَدَهُ بِعَيْنِه» . رَوَاهُ الشَّافِعِي وَابْن مَاجَه

Abu Khaldah al-Zuraqi reported: We came to Abu Hurayrah regarding a companion of ours who had become bankrupt. He said: ‘This is the ruling given by the Messenger of Allah (Allah bless him and give him peace): Any man who dies or becomes bankrupt, the owner of an item has a greater right to that item if he finds it intact.’ Al-Shafi‘i and Ibn Majah transmitted it. Its listed grading is da‘if (al-Albani).
