Mishkat al-Masabih 2962
وَعَنْهُ قَالَ: قَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِالشُّفْعَةِ فِي كُلِّ شَرِكَةٍ لَمْ تُقْسَمْ رَبْعَةٍ أَوْ حَائِطٍ: «لَا يَحِلُّ لَهُ أَن يَبِيع حَتَّى يُؤذن شَرِيكه فَإِن شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ فَإِذَا بَاعَ وَلَمْ يُؤْذِنْهُ فَهُوَ أَحَقُّ بِهِ» . رَوَاهُ مُسْلِمٌ

He also reported that the Messenger of Allah ﷺ ruled in favor of pre-emption in every undivided shared property, whether a house or a garden. “It is not lawful for him to sell until he informs his partner. If the partner wishes, he may take it; if he wishes, he may leave it. If the seller sells without informing him, the partner has the stronger claim to it.” Muslim narrated it.
