Amr ibn Shuaib reported from his father, from his grandfather, from the Messenger of Allah ﷺ, who was asked about fruit still hanging on trees. He said: “Whoever takes some because he is in need, without carrying any away in his garment, incurs no liability. Whoever takes any away must pay twice its value and be punished. Whoever steals from it after it has been gathered in the drying enclosure, and its value reaches the price of a shield, is subject to the prescribed hand-cutting penalty.” The narrator also mentioned stray camels and sheep. He said the Prophet ﷺ was asked about found property and replied: “Whatever is found on a well-traveled road or in a populated town, announce it for a year. If its owner comes, give it to him; if not, it is yours. Whatever is found in ancient ruined land, and buried treasure, is subject to a fifth.” Al-Nasai narrated it. Abu Dawud narrated the part beginning with the question about found property.
