حَدَّثَنَا بُنْدَارٌ، قال: حَدَّثَنَا أَبُو أَحْمَدَ الزُّبَيْرِيُّ، قال: حَدَّثَنَا سُفْيَانُ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ، عَنْ حَكِيمِ بْنِ حَكِيمِ بْنِ عَبَّادِ بْنِ حُنَيْفٍ، عَنْ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حُنَيْفٍ، قَالَ كَتَبَ عُمَرُ بْنُ الْخَطَّابِ إِلَى أَبِي عُبَيْدَةَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ " اللَّهُ وَرَسُولُهُ مَوْلَى مَنْ لاَ مَوْلَى لَهُ وَالْخَالُ وَارِثُ مَنْ لاَ وَارِثَ لَهُ " . قَالَ أَبُو عِيسَى وَفِي الْبَابِ عَنْ عَائِشَةَ وَالْمِقْدَامِ بْنِ مَعْدِيكَرِبَ . وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ .

Bundar narrated to us; Abu Ahmad al-Zubayri narrated to us; Sufyan narrated to us, from ‘Abd al-Rahman ibn al-Harith, from Hakim ibn Hakim ibn ‘Abbad ibn Hunayf, from Abu Umamah ibn Sahl ibn Hunayf, who said: ‘Umar ibn al-Khattab wrote to Abu ‘Ubaydah that the Messenger of Allah (peace and blessings be upon him) said, ‘Allah and His Messenger are the guardians of one who has no guardian, and the maternal uncle inherits from one who has no heir.’ Abu ‘Isa said: There are reports on this topic from ‘A’ishah and al-Miqdam ibn Ma‘dikarib. This is a hasan sahih hadith.
Notes and open questions — unreviewed
The Arabic says ‘wrote to Abu ‘Ubaydah’; it does not say that ‘Umar sent Abu Umamah with a letter. Mawla is rendered ‘guardian’ in the first clause.
عَنْ حَكِيمِ بْنِ حَكِيمِ بْنِ عَبَّادِ بْنِ حُنَيْفٍ،
The Arabic says ‘Umar wrote to Abu ‘Ubaydah, whereas the English witness says Abu Umamah was sent with a letter; it also omits compiler comments.
