Ibn Abi ‘Umar narrated to us; Sufyan narrated to us, from ‘Amr ibn Dinar, from ‘Awsajah, from Ibn ‘Abbas: A man died during the time of the Messenger of Allah (peace and blessings be upon him), leaving no heir except a slave whom he had freed. The Prophet gave him the man’s inheritance. Abu ‘Isa said: This is a hasan hadith. In this chapter, the practice among scholars is that when a man dies without leaving a male agnate, his estate is placed in the Muslims’ public treasury.
Notes and open questions — unreviewed
The source first reports that the freedman received the inheritance, then states a general practice among scholars for cases without a male agnate: placing the estate in the public treasury. Both statements are preserved in sequence.
The source adds the compiler’s grade and a general legal practice that may appear in tension with the specific report about a freedman inheriting.
Should both the specific report and the compiler’s stated practice be retained without harmonizing them? They are presented separately.
