Translation

Unreviewed translation. All hadiths in this collection are available in five languages. Titles and introductions may remain in Arabic.

Qutaybah narrated to us; al-Layth narrated to us, from Ishaq ibn ‘Abd Allah, from al-Zuhri, from Humayd ibn ‘Abd al-Rahman, from Abu Hurayrah, from the Prophet (peace and blessings be upon him), who said: ‘A killer does not inherit.’ Abu ‘Isa said: This hadith is not sound and is known only through this route. Ishaq ibn ‘Abd Allah ibn Abi Farwah was abandoned by some hadith scholars, including Ahmad ibn Hanbal. Scholars act according to this report, holding that a killer does not inherit whether the killing was intentional or accidental. Some said that if the killing was accidental, the killer does inherit; this is Malik’s view.

Notes and open questions — unreviewed
  • The source distinguishes Abu ‘Isa’s assessment of the report’s soundness from the legal practice and the differing view attributed to Malik. The translation does not resolve the disagreement.

The Arabic says the hadith is unsound, identifies a narrator criticized by hadith scholars, and records disagreement about accidental killing; the witness gives only the saying.

Should the compiler’s grading, narrator assessment, and legal disagreement be included? They are translated here.
