Qutaybah narrated to us; al-Layth narrated to us, from Ibn Shihab, from Sa‘id ibn al-Musayyab, from Abu Hurayrah: The Messenger of Allah (peace and blessings be upon him) ruled concerning the fetus of a woman from Banu Lihyan, who miscarried it dead, that compensation of a male or female slave be paid. Then the woman against whom this compensation had been ruled died. The Messenger of Allah ruled that her estate be inherited by her children and her husband, and that her blood-money be paid by her agnatic kin.
Abu ‘Isa said: Yunus narrated this hadith from al-Zuhri, from Sa‘id ibn al-Musayyab and Abu Salamah, from Abu Hurayrah, from the Prophet, with similar wording. Malik narrated it from al-Zuhri, from Abu Salamah, from Abu Hurayrah. Malik also narrated it from al-Zuhri, from Sa‘id ibn al-Musayyab, from the Prophet as a mursal report.
Notes and open questions — unreviewed
Ghurrah is compensation specified here as a male or female slave. The term ‘aql refers to blood-money, and ‘asabah to the deceased’s agnatic kin. The source records alternate routes, including a mursal version.
Ghurrah is an archaic compensation term and the source specifies its form as a male or female slave.
Should ghurrah be retained with the source’s own explanation? The translation gives both.
The Arabic gives alternate routes and a mursal variant, which the witness omits.
Should these transmission variants be retained? They are included here.
