Abu Kurayb narrated to us; Abu Usamah, Ibn Numayr, and Waki‘ narrated to us, from ‘Abd al-‘Aziz ibn ‘Umar ibn ‘Abd al-‘Aziz, from ‘Abd Allah ibn Mawhab—some say Ibn Wahb—from Tamim al-Dari, who said: I asked the Messenger of Allah (peace and blessings be upon him), ‘What is the practice concerning a man from among the polytheists who accepts Islam at the hands of a Muslim?’ The Messenger of Allah said, ‘He is the person closest to him in life and in death.’ Abu ‘Isa said: We know this hadith only through the narration of ‘Abd Allah ibn Wahb—also said to be Ibn Mawhab—from Tamim al-Dari. Some inserted Qabisah ibn Dhu’ayb between ‘Abd Allah ibn Wahb and Tamim, but that is not sound. Yahya ibn Hamzah narrated it from ‘Abd al-‘Aziz ibn ‘Umar and added Qabisah ibn Dhu’ayb; in my view that chain is not connected. Some scholars act according to this hadith. Others place the inheritance in the public treasury; this is al-Shafi‘i’s view, based on the Prophet’s statement, ‘Al-wala’ belongs to the one who emancipated.’

Notes and open questions — unreviewed
  • The source records variants between Ibn Mawhab and Ibn Wahb and notes that inserting Qabisah ibn Dhu’ayb is not sound and, in Abu ‘Isa’s view, leaves the chain disconnected. It also reports differing practice concerning the convert’s estate.

The source records competing transmitter names and rejects the insertion of Qabisah ibn Dhu’ayb as unsound and disconnected.

Should these chain variants and judgments remain explicit? They are translated from the source.

The witness omits extensive transmission criticism and the differing legal practice on the estate, including al-Shafi‘i’s position.

Should the full compiler commentary be translated? It is included here.
