Al-Ansari narrated to us: Ma'n informed us: Malik informed us, from Sa'd ibn Ishaq ibn Ka'b ibn Ujrah, from his aunt Zaynab bint Ka'b ibn Ujrah, that al-Furay'ah bint Malik ibn Sinan, the sister of Abu Sa'id al-Khudri, told her: I came to the Messenger of Allah asking permission to return to my family among the Banu Khudrah. My husband had gone out in pursuit of some runaway slaves he owned. When he reached the outskirts of al-Qadum, they caught up with him and killed him. I asked the Messenger of Allah to let me return to my family, because my husband had left me neither a home that he owned nor maintenance. He said: Yes. I left, but when I was in the chamber—or in the mosque—the Messenger of Allah called me, or had me summoned. He said: What did you say? I repeated the story I had told him about my husband. He said: Stay in your home until the prescribed term is complete. I observed my waiting period there for four months and ten days. When Uthman became caliph, he sent for me and asked about this. I told him, and he followed it and ruled accordingly. Muhammad ibn Bashshar narrated to us: Yahya ibn Sa'id narrated to us, from Sa'd ibn Ishaq ibn Ka'b ibn Ujrah, with a similar report in meaning. Abu Isa said: This hadith is hasan sahih. Most scholars among the Companions of the Prophet and others act on it and do not consider it permissible for a woman observing a waiting period to move from her husband's home until her waiting period ends. This is the view of Sufyan al-Thawri, al-Shafi'i, Ahmad, and Ishaq. Other scholars among the Companions and others said that a woman may observe her waiting period wherever she wishes, even if she does not remain in her husband's home. Abu Isa said: The first view is more sound.

  • The source preserves uncertainty over whether the Prophet called al-Furay'ah from the chamber or the mosque, and whether he called her directly or had her summoned.
