Ziyad ibn Ayyub al-Baghdadi narrated to us: Abbad ibn Awwam narrated to us, from Hilal ibn Khabbab, from Ikrimah, from Ibn Abbas, that Dubaa bint al-Zubayr came to the Prophet and said, ‘Messenger of Allah, I intend to perform Hajj. Should I make a stipulation?’ He replied, ‘Yes.’ She asked, ‘What should I say?’ He said, ‘Say: Here I am, O Allah, here I am. Here I am; my place of leaving ihram will be wherever You cause me to be held back.’

There are reports on this topic from Jabir, Asma bint Abi Bakr, and A'ishah. Abu Isa said: The hadith of Ibn Abbas is hasan sahih. Some scholars act on this and permit a stipulation for Hajj: if illness or another excuse then prevents the pilgrim, he may leave ihram. This is the view of al-Shafi'i, Ahmad, and Ishaq. Other scholars did not permit such a stipulation and said that even if one makes it, one may not leave ihram; they treat that person like someone who made no stipulation.

  • The quoted formula makes the pilgrim's release from ihram conditional on being prevented from continuing.
