Bishr ibn Adam, the grandson of Azhar al-Samman, the Basran, narrated to us: Isma'il ibn Sa'id ibn Ubayd Allah narrated to us: My father narrated to us, from Ziyad ibn Jubayr ibn Hayyah, from his father, from al-Mughirah ibn Shu'bah, that the Prophet (peace and blessings be upon him) said: 'The rider is behind the funeral procession, the walker may be wherever he wishes in relation to it, and the child is prayed over.' Abu Isa said: This is a hasan sahih hadith. Isra'il and more than one other narrator transmitted it from Sa'id ibn Ubayd Allah. Some scholars among the Prophet's Companions and others acted on it. They said that the child is prayed over even if it did not cry at birth, once it is known to have been formed. This is the view of Ahmad and Ishaq.

The source gives a condition involving istihlal and knowing that the child was created, using language whose legal scope is not further defined here.
Does 'did not cry at birth' accurately render istihlal without imposing a broader legal definition?
