When the Messenger of Allah (ﷺ) appointed a commander over a military expedition or an army, he would instruct him in private to fear Allah and to treat the Muslims who were with him well. He would then say: "Fight in the name of Allah and in the way of Allah. Fight those who disbelieve in Allah. Do not misappropriate the spoils of war, do not break trust, do not mutilate, and do not kill children. When you meet your enemy from among the polytheists, invite them to one of three courses of action. Whichever of them they accept, agree to it and withhold from them. Invite them to Islam; if they accept, agree to it and withhold from them. Then invite them to move from their territory to the land of the Emigrants, and inform them that if they do so, they will have what the Emigrants have and their obligations will be what the Emigrants' obligations are. If they refuse to move and choose to remain in their territory, inform them that they will be like the desert Arabs of the Muslims, subject to the decree of Allah that applies to the believers, and they will have no share in the spoils or booty unless they fight alongside the Muslims. If they refuse, then ask them to pay the Jizyah; if they accept, agree to it and withhold from them. If they refuse, then seek the help of Allah and fight them. If you besiege the people of a fortress and they want you to grant them safe conduct according to the judgment of Allah, do not grant them the judgment of Allah, for you do not know whether you will arrive at the judgment of Allah concerning them or not. Instead, grant them safe conduct according to your judgment, and then judge concerning them as you wish afterwards."
Sufyan ibn 'Uyaynah said: 'Alqamah said: I mentioned this Hadith to Muqatil ibn Hayyan, and he said: Muslim narrated it to me—Abu Dawud said: He is Ibn Haytam—from an-Nu'man ibn Muqrin, from the Prophet (ﷺ), similarly to the Hadith of Sulaiman ibn Buraidah.
