What Has Been Related About A Man Who Institutes An Endowment — Sunan Abi Dawud 2879

'Abd al-Hamid b. 'Abd Allah b. 'Abd Allah b. 'Umar b. al-Khattab copied for me: In the name of Allah, the Compassionate, the Merciful. This is what 'Abd Allah 'Umar wrote concerning Thamgh. He narrated part of his report similarly to the hadith of Nafi', saying: "Without locking up property (for oneself), so whatever of its fruit is spared shall go to the beggar and the deprived." He drove on the story, saying: If the guardian of Thamgh wishes, he may buy a slave with its fruit for its work. Mu'iqib wrote it, and 'Abd Allah b. al-Arqam witnessed it: In the name of Allah, the Compassionate, the Merciful. This is what 'Abd Allah 'Umar, the Commander of the Faithful, bequeathed—if any event should befall him—that Thamgh, Sirmah b. al-Akwa', the servant who is with it, and the hundred shares that are in Khaybar, as well as his servant who is with them, and the hundred shares that Muhammad, may Allah bless him and grant him peace, gave him in the valley, shall be held by Hafsah for as long as she lives. Then the one possessing sound judgment among her family shall hold it: it shall neither be sold nor bought, and it shall be spent wherever one sees fit upon the beggar, the deprived, and close relatives. There is no blame on the one who is its guardian if he eats from it, or feeds [others] from it, or buys a slave from it.
