Sahih al-Bukhari 5758
حَدَّثَنَا سَعِيدُ بْنُ عُفَيْرٍ، حَدَّثَنَا اللَّيْثُ، قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ خَالِدٍ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَضَى فِي امْرَأَتَيْنِ مِنْ هُذَيْلٍ اقْتَتَلَتَا، فَرَمَتْ إِحْدَاهُمَا الأُخْرَى بِحَجَرٍ، فَأَصَابَ بَطْنَهَا وَهْىَ حَامِلٌ، فَقَتَلَتْ وَلَدَهَا الَّذِي فِي بَطْنِهَا فَاخْتَصَمُوا إِلَى النَّبِيِّ صلى الله عليه وسلم فَقَضَى أَنَّ دِيَةَ مَا فِي بَطْنِهَا غُرَّةٌ عَبْدٌ أَوْ أَمَةٌ، فَقَالَ وَلِيُّ الْمَرْأَةِ الَّتِي غَرِمَتْ كَيْفَ أَغْرَمُ يَا رَسُولَ اللَّهِ مَنْ لاَ شَرِبَ، وَلاَ أَكَلَ، وَلاَ نَطَقَ، وَلاَ اسْتَهَلَّ، فَمِثْلُ ذَلِكَ يُطَلّ فَقَالَ النَّبِيُّ صلى الله عليه وسلم " إِنَّمَا هَذَا مِنْ إِخْوَانِ الْكُهَّانِ ".
Saʿīd ibn ʿUfair narrated to us: al-Layth narrated to us; he said: ʿAbd al-Raḥmān ibn Khālid narrated to us, from Ibn Shihāb, from Abū Salamah, from Abū Hurayrah: “The Messenger of Allah ﷺ ruled concerning two women from Hudhayl who had fought. One threw a stone at the other, striking her abdomen while she was pregnant and killing the child in her womb. They brought their dispute to the Prophet ﷺ, and he ruled that compensation for the fetus was a male or female slave.” The guardian of the woman who had to pay said, “How can I pay compensation for one who neither drank, ate, nor spoke, and did not cry at birth? A claim like that should be discarded.” The Prophet ﷺ said, “This is one of the utterances of the soothsayers.”
