Qutaybah narrated to us, from Mālik, from Ibn Shihāb, from Abū Salamah, from Abū Hurayrah (may Allah be pleased with him): “Two women fought, and one threw a stone at the other, causing her to miscarry. The Prophet ﷺ ruled that compensation for the fetus was a male or female slave.”
From Ibn Shihāb, from Saʿīd ibn al-Musayyab: “The Messenger of Allah ﷺ ruled that for a fetus killed in its mother’s womb, compensation was a male or female slave.” The person ordered to pay said, “How can I pay compensation for one who neither ate, drank, nor spoke, and did not cry at birth? A claim like that is void.” The Messenger of Allah ﷺ said, “This is one of the utterances of the soothsayers.”
