Abu Bakr ibn Abi Shaybah reported to us: Shababah reported to us, from Malik ibn Anas, from al-Zuhri, from Abdullah ibn Safwan, from his father: He slept in the mosque, using his upper garment as a pillow, and it was taken from beneath his head. He brought the thief to the Prophet (Allah bless him and grant him peace), and the Prophet ordered that the thief’s hand be cut off. Safwan said, ‘Messenger of Allah, I did not intend this; my garment is a charity for him.’ The Messenger of Allah said, ‘Why did you not do so before bringing him to me?’
Notes and open questions — unreviewed
The Arabic states that Safwan declared the garment a charity for the thief; it does not specify whether the garment had already been returned.
