Harmalah bin Yahya Al-Misri narrated to us: Abdullah bin Wahb narrated to us: Ibn Jurayj informed us, from Ibn Abi Mulaikah, from Ibn Abbas, that the Messenger of Allah (peace and blessings be upon him) said: If people were granted what they claim, some people would claim the lives and property of others. Rather, the oath is required of the one against whom the claim is made.

Notes and open questions — unreviewed
  • The Arabic says the oath is upon the defendant; “required” makes the procedural sense explicit, while the Arabic itself says “the oath is upon.”
