Oath should be sworn by the defendant Sahih Muslim 1711 b
Arabic hadith text
وَحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا مُحَمَّدُ بْنُ بِشْرٍ، عَنْ نَافِعِ بْنِ عُمَرَ، عَنِ ابْنِ، أَبِي مُلَيْكَةَ عَنِ ابْنِ عَبَّاسٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَضَىبِالْيَمِينِ عَلَى الْمُدَّعَى عَلَيْهِ .
Translation
Ibn 'Abbas reported that Allah's Messenger (ﷺ) pronounced judgment on the basis of oath by the defendant.
