Yusuf ibn Hammad al-Ma'ni al-Basri narrated to us: Abd al-A'la narrated to us, from Sa'id, from Qatadah, from Jabir ibn Zayd, from Ibn Abbas, that the Prophet said: The prostitutes are those who marry themselves without clear proof. Yusuf ibn Hammad said: Abd al-A'la transmitted this hadith as raised to the Prophet in the book of Tafsir, but in the Book of Divorce he transmitted it as stopping at Ibn Abbas and did not raise it to the Prophet.

Notes and open questions — unreviewed
  • The Arabic term bayyinah means clear evidence or proof. The wording about women marrying themselves is translated as phrased in the source.

  • أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏ "‏ الْبَغَايَا اللاَّتِي يُنْكِحْنَ أَنْفُسَهُنَّ بِغَيْرِ بَيِّنَةٍ ‏" ‏ ‏.

The Arabic uses a stigmatizing term for sexually immoral women, while the witness renders it as adulteresses.

Should the source's broad stigmatizing term be rendered literally as prostitutes, or more narrowly as adulteresses?
