Ishaq ibn Mansur informed us: Muhammad ibn Yusuf informed us: al-Awza'i narrated to us, from Yahya ibn Abi Kathir, from Abu Salamah, from Abu Hurairah, who said: The Messenger of Allah said: A previously married woman must not be married until she is consulted, and a virgin must not be married until her permission is sought; her silence is her permission. It is also reported in this chapter from Umar, Ibn Abbas, Aishah, and al-Urs ibn Umayrah. Abu Isa said: The hadith of Abu Hurairah is hasan sahih. The scholars act on this report: a previously married woman is not to be married until she is consulted. If her father marries her off without consulting her and she dislikes it, the marriage is annulled according to the majority of scholars. Scholars differed about fathers marrying off virgin daughters. Most scholars of Kufa and elsewhere held that if a father marries off his adult virgin daughter without her instruction and she does not approve, the marriage is annulled. Some scholars of Medina said that a father's marriage arrangement for a virgin is valid even if she dislikes it. This was the view of Malik ibn Anas, al-Shafi'i, Ahmad, and Ishaq.
Notes and open questions — unreviewed
The Arabic uses thayyib for a previously married woman and bikr for a virgin. The compiler records differing scholarly positions on a father's authority.
The compiler records this as the majority view in one passage, then reports a different view from some scholars of Medina and names later authorities.
Should the competing views be harmonized with an additional qualification, or retained as the source presents them?
