Mahmud ibn Ghaylan narrated to us: Abu Ahmad al-Zubayri narrated to us: Sufyan narrated to us, from Abu Qays, from Hudhayl ibn Shurahbil, from Abdullah ibn Mas'ud, who said: The Messenger of Allah cursed the muhill and the one for whom the tahlil is done. Abu Isa said: This hadith is hasan sahih. Abu Qays al-Awdi's name was Abd al-Rahman ibn Tharwan. This hadith has been narrated from the Prophet through more than one route. Scholars among the Companions of the Prophet acted on this, including Umar ibn al-Khattab, Uthman ibn Affan, Abdullah ibn Umar, and others. This was also the view of the jurists among the Successors, and it was held by Sufyan al-Thawri, Ibn al-Mubarak, al-Shafi'i, Ahmad, and Ishaq. I heard al-Jarud ibn Mu'adh mention from Waki that he held this view and said that this chapter of the rationalists' opinions should be discarded. Al-Jarud said: Waki said that Sufyan said: If a man marries a woman in order to make her lawful for another man, then later decides to keep her, he may not keep her unless he marries her through a new marriage contract.

Notes and open questions — unreviewed
  • Muhill and muhallal lahu are technical terms for the intermediary and the former husband in a marriage arranged to permit remarriage after an irrevocable divorce.

  • قَالَ لَعَنَ رَسُولُ اللَّهِ صلى الله عليه وسلم الْمُحِلَّ وَالْمُحَلَّلَ لَهُ ‏ .

The Arabic uses technical terms whose exact scope depends on the prohibited arranged marriage practice being discussed.

Should these technical terms be transliterated with the explanatory note, or translated into plain English in the hadith text?
