Ibn ʿAbbās reported that the Messenger of Allah said: “A partner has the right of preemption, and preemption applies to everything.” Abū ʿĪsā said: We know this wording only through Abū Ḥamzah al-Sukkarī. More than one narrator transmitted it from ʿAbd al-ʿAzīz ibn Rufayʿ, from Ibn Abī Mulaykah, from the Prophet as a mursal report; this version is more accurate. Abū Bakr ibn ʿAyyāsh and Abū al-Aḥwaṣ narrated similar versions without mentioning Ibn ʿAbbās, and these are more accurate than Abū Ḥamzah’s version. Abū Ḥamzah was trustworthy; the mistake may have come from someone else. Most scholars held that preemption applies only to houses and land, not to all things. Some held that it applies to everything, but the first view is sounder.

  • The report’s broad wording is followed by the compiler’s preference for the more specific land and housing rule.
