حَدَّثَنَا عُقْبَةُ بْنُ مُكْرَمٍ الْعَمِّيُّ الْبَصْرِيُّ، وَغَيْرُ، وَاحِدٍ، قَالُوا حَدَّثَنَا مُحَمَّدُ بْنُ بَكْرٍ الْبُرْسَانِيُّ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ قَتَادَةَ، وَعَاصِمٍ الأَحْوَلِ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ " . قَالَ أَبُو عِيسَى وَلاَ نَعْلَمُ أَحَدًا ذَكَرَ فِي هَذَا الْحَدِيثِ عَاصِمًا الأَحْوَلَ عَنْ حَمَّادِ بْنِ سَلَمَةَ غَيْرَ مُحَمَّدِ بْنِ بَكْرٍ . وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ . - وَقَدْ رُوِيَ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ " . رَوَاهُ ضَمْرَةُ بْنُ رَبِيعَةَ عَنِ الثَّوْرِيِّ عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صلى الله عليه وسلم . وَلَمْ يُتَابَعْ ضَمْرَةُ عَلَى هَذَا الْحَدِيثِ وَهُوَ حَدِيثٌ خَطَأٌ عِنْدَ أَهْلِ الْحَدِيثِ .

Samurah reported that the Prophet said: “Whoever owns a close unmarriageable relative, that person is free.” Abū ʿĪsā said: We know no one besides Muḥammad ibn Bakr al-Bursānī who mentioned ʿĀṣim al-Aḥwal in this report from Ḥammād ibn Salamah. Some scholars acted according to this hadith. A report with similar wording is narrated from Ibn ʿUmar, but its narrator Ḍamrah was not corroborated, and hadith scholars considered it mistaken.
