Sales in which a Price is paid for Goods to be Delivered Later (As-Salam)

Amr ibn Zurara narrated to us: Ismail ibn Ulayya informed us: Ibn Abi Najih informed us, from Abdullah ibn Kathir, from Abu al-Minh al, from Ibn Abbas, may Allah be pleased with them both, who said: The Messenger of Allah came to Medina while people were making advance payments for produce for one or two years—or he said two or three years. Ismail was uncertain. He said: “Whoever makes an advance payment for dates should do so for a known measure and a known weight.”

Muhammad narrated to us: Ismail informed us, from Ibn Abi Najih, with this wording: “For a known measure and a known weight.”

Sadaqa narrated to us: Ibn Uyayna informed us: Ibn Abi Najih informed us, from Abdullah ibn Kathir, from Abu al-Minh al, from Ibn Abbas, may Allah be pleased with them both, who said: The Prophet came to Medina while people were making advance payments for dates for two or three years. He said: “Whoever makes an advance payment for anything must specify a known measure, a known weight, and a known term.”

Ali narrated to us: Sufyan narrated to us; he said: Ibn Abi Najih narrated to me, saying: “He should make the advance payment for a known measure and a known term.”

Qutayba narrated to us: Sufyan narrated to us, from Ibn Abi Najih, from Abdullah ibn Kathir, from Abu al-Minh al, who said: I heard Ibn Abbas, may Allah be pleased with them both, say: The Prophet arrived and said: “For a known measure, a known weight, and a known term.”

Abu al-Walid narrated to us: Shuba narrated to us, from Ibn Abi al-Mujalid. Yahya narrated to us: Waki narrated to us, from Shuba, from Muhammad ibn Abi al-Mujalid. Hafs ibn Umar narrated to us: Shuba narrated to us; he said: Muhammad—or Abdullah—ibn Abi al-Mujalid informed me; he said: Abdullah ibn Shaddad ibn al-Had and Abu Burda differed about advance sales, so they sent me to Ibn Abi Awfa, may Allah be pleased with him, and I asked him. He replied: “In the time of the Messenger of Allah, Abu Bakr, and Umar, we used to make advance payments for wheat, barley, raisins, and dates.” I also asked Ibn Abza, and he said the same.

Musa ibn Ismail narrated to us: Abd al-Wahid narrated to us: al-Shaybani narrated to us: Muhammad ibn Abi al-Mujalid narrated to us; he said: Abdullah ibn Shaddad and Abu Burda sent me to Abdullah ibn Abi Awfa, may Allah be pleased with them both, saying, “Ask him whether the Companions of the Prophet used to make advance payments for wheat in the time of the Prophet.” Abdullah said: “We used to make advance payments to the Nabits of Syria for wheat, barley, and oil, in a known measure and for a known term.” I asked, “Did they themselves have the goods?” He replied, “We did not ask them about that.” Then they sent me to Abd al-Rahman ibn Abza, and I asked him. He said: “The Companions of the Prophet used to make advance payments in the time of the Prophet, and we did not ask them whether they had crops or not.”

Ishaq narrated to us: Khalid ibn Abdullah narrated to us, from al-Shaybani, from Muhammad ibn Abi al-Mujalid, with the same report; he said: “We used to make advance payments to them for wheat and barley.” Abdullah ibn al-Walid narrated from Sufyan, from al-Shaybani, who said: “And oil.” Qutayba narrated to us: Jarir narrated to us, from al-Shaybani, who said: “For wheat, barley, and raisins.”

Adam narrated to us: Shuba narrated to us: Amr informed us; he said: I heard Abu al-Bakhtari al-Tai say: I asked Ibn Abbas, may Allah be pleased with them both, about advance sales for date palms. He replied: “The Prophet forbade selling dates on the palm until they could be eaten and weighed.” A man asked, “What is to be weighed?” A man beside him said, “Until they have been gathered and secured.” Muadh said: Shuba narrated to us, from Amr, who said: Abu al-Bakhtari said: I heard Ibn Abbas, may Allah be pleased with them both, report that the Prophet forbade the same.

Abu al-Walid narrated to us: Shuba narrated to us, from Amr, from Abu al-Bakhtari, who said: I asked Ibn Umar, may Allah be pleased with them both, about advance sales for date palms. He replied: “The sale of date palms is forbidden until they ripen, and the sale of silver for deferred delivery in exchange for immediate payment is forbidden.” I asked Ibn Abbas about advance sales for date palms. He replied: “The Prophet forbade selling date palms until they could be eaten from and weighed.”

Muhammad ibn Bashshar narrated to us: Ghundar narrated to us: Shuba narrated to us, from Amr, from Abu al-Bakhtari, who said: I asked Ibn Umar, may Allah be pleased with them both, about advance sales for dates. Ibn Umar replied: “The Prophet forbade selling produce until it ripened, and forbade silver for gold on deferred delivery in exchange for immediate payment.” I also asked Ibn Abbas. He replied: “The Prophet forbade selling dates until they could be eaten from and weighed.” I asked him, “What is to be weighed?” A man beside Ibn Abbas said: “Until they have been harvested and secured.”

Muhammad narrated to us: Yala narrated to us: al-Amash narrated to us, from Ibrahim, from al-Aswad, from Aisha, may Allah be pleased with her, who said: The Messenger of Allah bought food from a Jewish man on deferred payment and pledged an iron coat of armor to him.

Muhammad ibn Mahbub narrated to me: Abd al-Wahid narrated to us: al-Amash narrated to us; he said: We discussed pledging security in an advance sale in the presence of Ibrahim. He said: al-Aswad narrated to me, from Aisha, may Allah be pleased with her, that the Prophet bought food from a Jewish man for a specified term and took an iron coat of armor from him as security.

Abu Nuaym narrated to us: Sufyan narrated to us, from Ibn Abi Najih, from Abdullah ibn Kathir, from Abu al-Minh al, from Ibn Abbas, may Allah be pleased with them both, who said: The Prophet came to Medina while people were making advance payments for produce for two or three years. He said: “Make advance payments for produce according to a known measure and for a known term.” Abdullah ibn al-Walid said: Sufyan narrated to us, from Ibn Abi Najih, with the wording: “According to a known measure and a known weight.”

Muhammad ibn Muqatil narrated to us: Abdullah informed us: Sufyan informed us, from Sulayman al-Shaybani, from Muhammad ibn Abi al-Mujalid, who said: Abu Burda and Abdullah ibn Shaddad sent me to Abd al-Rahman ibn Abza and Abdullah ibn Abi Awfa. I asked them about advance sales. They said: “We used to obtain spoils of war with the Messenger of Allah. Nabits from among the Nabits of Syria would come to us, and we would make advance payments to them for wheat, barley, and raisins for a specified term.” I asked whether they had crops or not. They replied: “We did not ask them about that.”

Musa ibn Ismail narrated to us: Juwayriya informed us, from Nafi, from Abdullah, may Allah be pleased with him, who said: They used to trade camels on the basis of habal al-habala, and the Prophet forbade it. Nafi explained it as waiting until the she-camel gives birth to what is in her womb.
