ʿAbd Rabbih ibn Khālid al-Numayrī narrated to us: Fuḍayl ibn Sulaymān narrated to us: Mūsā ibn ʿUqbah narrated to us: Isḥāq ibn Yaḥyā ibn al-Walīd narrated to us, from ʿUbādah ibn al-Ṣāmit, who said: The Messenger of God, peace and blessings be upon him, ruled that a mine is without liability, a well is without liability, and injury caused by an animal is without liability. An animal is a beast of livestock or another kind. “Without liability” means a loss for which no compensation is owed.

Aḥmad ibn al-Azhar narrated to us: ʿAbd al-Razzāq narrated to us, from Maʿmar, from Hammām, from Abū Hurayrah, who said: The Messenger of God, peace and blessings be upon him, said: “A fire is without liability, and a well is without liability.”

Yaḥyā ibn Ḥakīm narrated to us: Bishr ibn ʿUmar narrated to us: I heard Mālik ibn Anas. Abū Laylā ibn ʿAbd Allāh ibn ʿAbd al-Raḥmān ibn Sahl ibn Ḥunayf narrated to me, from Sahl ibn Abī Ḥathmah, who informed him from men among the elders of his people that ʿAbd Allāh ibn Sahl and Muḥayyisah had gone to Khaybar because hardship had befallen them. Someone came to Muḥayyisah and informed him that ʿAbd Allāh ibn Sahl had been killed and thrown into a pit or a spring at Khaybar. He went to the Jews and said, “By God, you killed him.” They said, “By God, we did not kill him.” Then he returned to his people and told them about it. He then came with his older brother Ḥuwayyiṣah and ʿAbd al-Raḥmān ibn Sahl. Muḥayyisah, who had been at Khaybar, began to speak, but the Messenger of God, peace and blessings be upon him, said to him, “Let the older one speak first,” meaning in age. Then Ḥuwayyiṣah spoke, followed by Muḥayyisah. The Messenger of God, peace and blessings be upon him, said: “Either they will pay blood money for your companion, or they will declare that they are at war.” The Messenger of God, peace and blessings be upon him, wrote to them about it, and they wrote back, “By God, we did not kill him.” The Messenger of God, peace and blessings be upon him, said to Ḥuwayyiṣah, Muḥayyisah, and ʿAbd al-Raḥmān: “Will you swear an oath and thereby establish your claim to blood money for your companion?” They said, “No.” He said, “Then will the Jews swear an oath for you?” They said, “They are not Muslims.” So the Messenger of God, peace and blessings be upon him, paid the blood money himself and sent them one hundred she-camels, which were brought into their house. Sahl said: One of them, a red she-camel, kicked me.

ʿAbd Allāh ibn Saʿīd narrated to us: Abū Khālid al-Aḥmar narrated to us, from Ḥajjāj, from ʿAmr ibn Shuʿayb, from his father, from his grandfather, that Ḥuwayyiṣah and Muḥayyisah, the sons of Masʿūd, and ʿAbd Allāh and ʿAbd al-Raḥmān, the sons of Sahl, went out to gather provisions at Khaybar. ʿAbd Allāh was attacked and killed. This was mentioned to the Messenger of God, peace and blessings be upon him, and he said: “Will you swear oaths and thereby establish your claim?” They said, “Messenger of God, how can we swear when we did not witness it?” He said, “Then the Jews will absolve you of the claim.” They said, “Messenger of God, then they will kill us.” So the Messenger of God, peace and blessings be upon him, paid the blood money himself.

Abū Bakr ibn Abī Shaybah narrated to us: Isḥāq ibn Manṣūr narrated to us: ʿAbd al-Salām narrated to us, from Isḥāq ibn ʿAbd Allāh ibn Abī Farwah, from Salamah ibn Rawḥ ibn Zinbāʿ, from his grandfather, that he came to the Prophet, peace and blessings be upon him, after having castrated a young male slave of his. The Prophet, peace and blessings be upon him, freed the slave as retribution for the mutilation.

Rajāʾ ibn al-Murajjā al-Samarqandī narrated to us: al-Naḍr ibn Shumayl narrated to us: Abū Ḥamzah al-Ṣayrafī narrated to us: ʿAmr ibn Shuʿayb narrated to me, from his father, from his grandfather, who said: A man came screaming to the Prophet, peace and blessings be upon him. The Messenger of God, peace and blessings be upon him, asked him, “What is the matter?” He said, “My master saw me kissing a slave woman of his and cut off my genitals.” The Prophet, peace and blessings be upon him, said, “Bring me the man.” They sought him but could not find him. The Messenger of God, peace and blessings be upon him, said: “Go, you are free.” He said, “Who will protect me, Messenger of God?” He added, “What if my master enslaves me again?” The Messenger of God, peace and blessings be upon him, said: “Every believer or Muslim is responsible for your protection.”

Yaʿqūb ibn Ibrāhīm al-Dawraqī narrated to us: Hushaym narrated to us, from Mughīrah, from Shibāk, from Ibrāhīm, from ʿAlqamah, who said: ʿAbd Allāh said: The Messenger of God, peace and blessings be upon him, said: “Among people, the most restrained in killing are the people of faith.”

ʿUthmān ibn Abī Shaybah narrated to us: Ghundar narrated to us, from Shuʿbah, from Mughīrah, from Shibāk, from Ibrāhīm, from Hunayy ibn Nuwayrah, from ʿAlqamah, from ʿAbd Allāh, who said: The Messenger of God, peace and blessings be upon him, said: “The most restrained of people in killing are the people of faith.”

Muḥammad ibn ʿAbd al-Aʿlā al-Ṣanʿānī narrated to us: al-Muʿtamir ibn Sulaymān narrated to us, from his father, from Ḥanash, from ʿIkrimah, from Ibn ʿAbbās, from the Prophet, peace and blessings be upon him, who said: “The Muslims are equal in blood, and they stand together against those outside their community. The protection granted by the least among them is binding on them all, and their farthest member may return under their protection.”

Ibrāhīm ibn Saʿīd al-Jawharī narrated to us: Anas ibn ʿIyāḍ Abū Ḍamrah narrated to us, from ʿAbd al-Salām ibn Abī al-Janūb, from al-Ḥasan, from Maʿqil ibn Yasār, who said: The Messenger of God, peace and blessings be upon him, said: “The Muslims stand together against those outside their community, and their blood is equal.”

Hishām ibn ʿAmmār narrated to us: Ḥātim ibn Ismāʿīl narrated to us, from ʿAbd al-Raḥmān ibn ʿAyyāsh, from ʿAmr ibn Shuʿayb, from his father, from his grandfather, who said: The Messenger of God, peace and blessings be upon him, said: “The Muslims stand together against those outside their community, their blood is equal, the protection granted by the least among them is binding on them all, and their farthest member may grant protection on their behalf.”

Abū Kurayb narrated to us: Abū Muʿāwiyah narrated to us, from al-Ḥasan ibn ʿAmr, from Mujāhid, from ʿAbd Allāh ibn ʿAmr, who said: The Messenger of God, peace and blessings be upon him, said: “Whoever kills a person with whom there is a covenant will not smell the fragrance of Paradise, though its fragrance can be found from a distance of forty years.”

Muḥammad ibn Bashshār narrated to us: Maʿdī ibn Sulaymān narrated to us: Ibn ʿAjlān informed us, from his father, from Abū Hurayrah, from the Prophet, peace and blessings be upon him, who said: “Whoever kills a person under the protection of God and His Messenger will not smell the fragrance of Paradise, though its fragrance can be found from a distance of seventy years.”

Muḥammad ibn ʿAbd al-Malik ibn Abī al-Shawārib narrated to us: Abū ʿAwānah narrated to us, from ʿAbd al-Malik ibn ʿUmayr, from Rifāʿah ibn Shaddād al-Qitbānī, who said: Were it not for a statement I heard from ʿAmr ibn al-Ḥamiq al-Khuzāʿī, I would have walked between the head of al-Mukhtār and his body. I heard him say: The Messenger of God, peace and blessings be upon him, said: “Whoever gives a man assurance of safety for his life, then kills him, will carry a banner of treachery on the Day of Resurrection.”

ʿAlī ibn Muḥammad narrated to us: Wakīʿ narrated to us: Abū Laylā narrated to us, from Abū ʿAkkāshah, from Rifāʿah, who said: I entered upon al-Mukhtār in his palace, and he said, “Jibrīl has just left me.” The only thing that kept me from striking his neck was a report I heard from Sulaymān ibn Ṣurad, from the Prophet, peace and blessings be upon him, that he said: “If a man entrusts you with his life, do not kill him.” That is what kept me from doing it.

Abū Bakr ibn Abī Shaybah and ʿAlī ibn Muḥammad said: Abū Muʿāwiyah narrated to us, from al-Aʿmash, from Abū Ṣāliḥ, from Abū Hurayrah, who said: A man was killed during the time of the Messenger of God, peace and blessings be upon him, and the matter was brought to the Prophet, peace and blessings be upon him. He handed the killer over to the victim next of kin. The killer said, “Messenger of God, by God, I did not intend to kill him.” The Messenger of God, peace and blessings be upon him, said to the next of kin: “If he is telling the truth and you kill him, you will enter the Fire.” So he released him. The man had been bound with a strap, and he went out dragging it, so he was called Dhū al-Nisʿah, “the one with the strap.”

Abū ʿUmayr, ʿĪsā ibn Muḥammad al-Naḥḥās, ʿĪsā ibn Yūnus, and al-Ḥusayn ibn Abī al-Sarī al-ʿAsqalānī said: Ḍamrah ibn Rabīʿah narrated to us, from Ibn Shawdhab, from Thābit al-Bunānī, from Anas ibn Mālik, who said: A man brought the killer of his relative to the Messenger of God, peace and blessings be upon him. The Prophet, peace and blessings be upon him, said, “Pardon him.” He refused. He said, “Take the compensation for the injury.” He refused. He said: “Go and kill him, for then you will be like him.” The man caught up with the killer, and someone told him that the Messenger of God, peace and blessings be upon him, had said, “Kill him, for then you will be like him.” So he released him. He was seen going home, dragging his strap. The narrator said, “It seems he had tied him up.” Abū ʿUmayr said in his version: Ibn Shawdhab said, from ʿAbd al-Raḥmān ibn al-Qāsim: After the Prophet, peace and blessings be upon him, no one may say that he should be killed because he would be like him. Ibn Mājah said: “This is the report of the people of al-Raml; it is found only with them.”

Isḥāq ibn Manṣūr informed us: Ḥabbān ibn Hilāl informed us: ʿAbd Allāh ibn Bakr al-Muzanī narrated to us, from ʿAṭāʾ ibn Abī Maymūnah, who said: As far as I know, he related it only from Anas ibn Mālik, who said: No case involving retaliation was brought before the Messenger of God, peace and blessings be upon him, without his ordering that pardon be granted.

ʿAlī ibn Muḥammad narrated to us: Wakīʿ narrated to us, from Yūnus ibn Abī Isḥāq, from Abū al-Safar, who said: Abū al-Dardāʾ said: I heard the Messenger of God, peace and blessings be upon him, say: “Whenever a man suffers an injury to some part of his body and waives his claim to it, God raises him a degree thereby or erases one of his sins.” My own ears heard it and my heart retained it.

Muḥammad ibn Yaḥyā narrated to us: Abū Ṣāliḥ narrated to us, from Ibn Lahīʿah, from Ibn Anʿum, from ʿUbādah ibn Nusayy, from ʿAbd al-Raḥmān ibn Ghanm, who narrated to us from Muʿādh ibn Jabal, Abū ʿUbaydah ibn al-Jarrāḥ, ʿUbādah ibn al-Ṣāmit, and Shaddād ibn Aws, that the Messenger of God, peace and blessings be upon him, said: “If a woman commits intentional murder, she is not to be executed until she delivers what is in her womb, if she is pregnant, and until care of her child is guaranteed. If she commits unlawful sexual intercourse, she is not to be stoned until she delivers what is in her womb and until care of her child is guaranteed.”
